Common Types of Family-Based Visas

Immediate Relative Immigrant Visas

These visas are for close family members of U.S. citizens. There is no numerical limit on the number of these visas issued each year.

Family Preference Immigrant Visas

These visas are for specific, more distant family relationships with a U.S. citizen and certain specified relationships with a lawful permanent resident (LPR). These visas are limited in number each year.

  1. F1 (First Preference): Unmarried sons and daughters (21 years of age and older) of U.S. citizens.
  2. F2A (Second Preference A): Spouses and unmarried children (under 21 years of age) of LPRs.
  3. F2B (Second Preference B): Unmarried sons and daughters (21 years of age and older) of LPRs.
  4. F3 (Third Preference): Married sons and daughters of U.S. citizens.
  5. F4 (Fourth Preference): Brothers and sisters of U.S. citizens (if the U.S. citizen is 21 years of age and older).

Process Overview

  1. Petition: The U.S. citizen or LPR must file a Form I-130, Petition for Alien Relative, with U.S. Citizenship and Immigration Services (USCIS).
  2. Approval: Once the petition is approved, it is sent to the National Visa Center (NVC) for further processing.
  3. Visa Availability: For family preference categories, beneficiaries must wait for a visa number to become available.
  4. Consular Processing or Adjustment of Status: If the beneficiary is outside the U.S., they will undergo consular processing. If they are inside the U.S., they may apply for adjustment of status using Form I-485.
